ARTICLE 1 — OVERVIEW

This website is operated by FBA Ventures LLC, trading as Kaleo Pilates. The terms "we," "our," and "us" refer to Kaleo Pilates. By visiting this website and/or purchasing a product, you agree to be bound by these Terms of Service in their entirety. These terms apply to all users of the site, including browsers, customers, and merchants.

ARTICLE 2 — ACCURACY OF INFORMATION

We make every effort to present our Pilates products as accurately as possible. However, we do not warrant that product descriptions, pricing, or any other content on this site are free from errors, inaccuracies, or omissions. We reserve the right to correct any error, inaccuracy, or omission and to modify or update information at any time without prior notice. Prices are subject to change without notice.

ARTICLE 3 — ORDERS & PAYMENT

We reserve the right to refuse any order placed on this site. In the event that an order is modified, cancelled, or refused, we will make reasonable efforts to notify you via the email address or phone number provided at checkout. By placing an order, you represent that you are providing current, complete, and accurate purchase information for all transactions. You agree to promptly update your account information so that we may complete your transaction and contact you as needed.

ARTICLE 4 — DELIVERY & TRANSFER OF RISK

Risk of loss and title to the products transfer to the buyer at the moment the buyer, or a third party designated by the buyer, takes physical possession of the products. From that point forward, the buyer assumes full responsibility for the goods. Kaleo Pilates cannot be held liable for any loss or damage occurring after delivery has been completed.

ARTICLE 5 — RETURNS & REFUNDS

You have 14 days from the date of delivery to request a return on eligible items, provided the product is unused and returned in its original packaging. Return shipping costs are the sole responsibility of the customer. Large Pilates apparatus is strictly non-returnable and non-refundable unless a manufacturing defect or shipping error on our part is confirmed. Please refer to our Return & Refund Policy for full details, conditions, and procedures. That policy forms an integral part of these Terms of Service.

ARTICLE 6 — LIABILITY

Kaleo Pilates shall not be held liable for any injury, loss, or damage arising from the improper use of any equipment or accessory purchased on this site. The use of all Pilates equipment and accessories is undertaken at the sole risk and responsibility of the user. Users are advised to consult a qualified fitness or medical professional before using any Pilates apparatus, particularly in cases of pre-existing injury or medical condition.

To the fullest extent permitted by applicable law, FBA Ventures LLC's total liability for any claim shall not exceed the amount paid by the buyer for the specific order giving rise to that claim. We shall not be liable for any indirect, incidental, consequential, or punitive damages of any kind.

ARTICLE 7 — INTELLECTUAL PROPERTY

All content on kaleopilates.com, including but not limited to text, graphics, logos, images, and icons, is the exclusive property of Kaleo Pilates — FBA Ventures LLC, unless otherwise stated. No content may be reproduced, distributed, or used in any form without prior written consent from Kaleo Pilates.

ARTICLE 8 — CHARGEBACKS & DISPUTES

Before initiating any chargeback or payment dispute with your bank or credit card provider, you are required to contact us first at contact@kaleopilates.com and allow us a reasonable opportunity to resolve your concern. By placing an order, you agree that all transaction records, communications, tracking data, and delivery confirmations will be submitted as evidence to the relevant payment processor or card network in the event of a dispute. Filing a chargeback on a legitimately fulfilled order constitutes first-party fraud and will be challenged and reported accordingly.

ARTICLE 9 — GOVERNING LAW & JURISDICTION

These Terms of Service are governed exclusively by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these terms or any purchase made on kaleopilates.com shall be subject to the exclusive jurisdiction of the courts of the State of Wyoming, United States.

ARTICLE 10 — MODIFICATIONS

We reserve the right to update or modify these Terms of Service at any time. Changes take effect immediately upon publication on this page. Your continued use of the website following any modification constitutes your acceptance of the updated terms.
