TERMS OF SALE

1. PURPOSE

These Terms of Sale govern all purchases made on kaleopilates.com and define the contractual relationship between Kaleo Pilates, operated by FBA Ventures LLC, and the buyer, whether a private consumer or a business entity. By placing an order, the buyer accepts these terms in their entirety.

2. PRICING

Prices displayed on product pages are shown in the applicable currency at checkout and are inclusive of all applicable taxes where required by law. Kaleo Pilates reserves the right to modify its prices at any time. The price applicable to any given order is the price confirmed at the time of checkout — price changes after an order has been placed do not affect that order. Shipping fees, where applicable, are calculated and displayed before final order confirmation.

3. ORDER & PAYMENT

The buyer selects the products they wish to purchase by adding them to the cart. Payment is due in full at the time of checkout. Validating your order constitutes a binding commitment to pay the price indicated. All payments are processed via credit card or any other secure payment method available at checkout. All transactions are processed through encrypted, secure payment infrastructure. Kaleo Pilates does not store any payment card information.

For large apparatus orders, production is initiated upon receipt of full payment. Once production has begun, the order cannot be cancelled or modified under any circumstances.

4. DELIVERY

Products are delivered to the shipping address provided during the checkout process. It is the buyer's sole responsibility to ensure this address is accurate and complete. Delivery timelines are estimates and are not contractually guaranteed. Kaleo Pilates cannot be held liable for delays caused by carriers, customs authorities, weather events, or any other circumstance beyond our reasonable control. In the event of a significant delay, the buyer will be notified by email.

5. WARRANTY & LIABILITY

All products sold on kaleopilates.com are warranted against manufacturing defects under normal use conditions. This warranty does not cover damage resulting from misuse, improper assembly, unauthorized modifications, excessive load, normal wear and tear, or accidental damage.

Any defect must be reported within 48 hours of delivery to contact@kaleopilates.com, with photographic evidence and your order number. Kaleo Pilates shall not be held liable for any injury, loss, or damage arising from improper use of the purchased equipment, including but not limited to inappropriate exercise routines or exceeding recommended weight limits.

To the fullest extent permitted by applicable law, FBA Ventures LLC's total liability shall not exceed the amount paid by the buyer for the specific order giving rise to the claim. Kaleo Pilates shall not be liable for any indirect, incidental, consequential, or punitive damages of any kind.

6. CHARGEBACKS & DISPUTE RESOLUTION

Before initiating any chargeback or payment dispute with your bank or credit card provider, you are required to contact us first at contact@kaleopilates.com and allow us a reasonable opportunity to resolve your concern.

By placing an order, you expressly agree that:

  • You will exhaust our internal resolution process before contacting your financial institution.
  • All transaction records, order confirmations, tracking data, delivery proofs, and communications are systematically archived and will be submitted in full to the relevant payment processor or card network as evidence in any dispute.
  • Filing a chargeback on a legitimately processed, shipped, and delivered order constitutes first-party fraud and will be challenged, reported, and contested to the fullest extent permitted by law.
  • Customers who file unjustified chargebacks will be permanently banned from placing future orders on kaleopilates.com.
  • FBA Ventures LLC reserves the right to pursue all available legal remedies, including recovery of the disputed amount, legal fees, and damages.

7. GOVERNING LAW & JURISDICTION

These Terms of Sale are governed exclusively by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these terms or any purchase on kaleopilates.com shall be subject to the exclusive jurisdiction of the courts of the State of Wyoming, United States.
